Direxion Shares ETF Trust, Direxion Funds (the “Funds”), and Rafferty Asset Management, LLC (collectively, “Direxion”) are committed to maintaining the highest standards of confidentiality and respect for privacy of your personal information.  We recognize that you have entrusted us with non-public personal and financial information in the course of doing business, and understand that protecting and safeguarding this information is important. 

Information Direxion Collects About You

Direxion collects non-public personal information from various sources.  This includes account applications that are required to open and service any investments, included in Fund accounts, and information gathered when you request information or materials from Direxion.  The information collected from you or your representative includes items such as your address, phone number, and social security number.  Direxion may also receive information regarding your investment transactions, account balances, and correspondence between you and Direxion or third parties, such as the third party service providers.  This information is used to process transactions, respond to inquiries from you, deliver reports, products and services, and fulfill legal and regulatory requirements. 

Additionally, our website uses “cookies” and other similar technology to help measure and track visitors to the website and to collect certain technical and navigational information about you such as, operating system version, browser type, internet protocol address, pages visited, date and time of your visit, and your general geographic location.  The information obtained helps Direxion understand how our website is used and may be used to serve you better by improving website design and functionality or to provide customized services and information to you.  Direxion may also use similar tracking technologies in emails that Direxion or other service providers may send to you.  The use of cookies and similar technologies is common practice on the internet and many browsers are configured to accept cookies automatically.  You can configure your browser to accept all cookies, reject all cookies, notify you when a cookie is set and thereby allowing you to decide whether or not to accept a cookie, or delete cookies that have already been set.  Each browser is different, but generally, the browser’s “help” feature will provide instructions related to cookies, or you may seek online assistance to learn how to change your browser settings. 

Direxion may also use third party advertising companies, such as Google, to serve online ads for the Funds to you on Direxion’s behalf based on your visits to Direxion’s website or to other websites.  These ads may appear on a wide variety of websites, which have no affiliation with the Funds.  Direxion does not collect or share any personally identifiable information with these advertising companies or websites and they do not collect or share personally identifiable information with Direxion.  Third party advertising companies may use cookies or similar technologies to measure and improve the effectiveness of advertising for their clients, including Direxion.  These companies do so by collecting and using limited technical and other anonymous information about your browsing activity, potentially including:  date and/or time the ad is shown, cookies, internet protocol (IP) address information, browser and device information, etc.  You may opt-out of receiving third party advertisements by visiting Google’s Ads Settings and by visiting the Network Advertising opt-out page. 

How Your Personal Information is Safeguarded?

Direxion does not disclose or sell any non-public personal or financial information about you, except (1) to our affiliated entities and third-party service providers who assist in operating our business, such as financial intermediaries, custodians, transfer agents, marketing consultants, outside accountants, and external legal counsel; (2) as required by law, regulation, or court order; (3) at your request; or (4) with your consent.  Sharing information with certain third parties who are not affiliated with Direxion that maintain or service customer accounts is essential.  Direxion may also share information with companies that perform administrative services, such as printing and mailing Fund documents, or marketing services for the Funds, including research firms.  When Direxion enters into such relationships with third parties, the use of customers’ information is restricted and they are prohibited from sharing customer information or using it for any purposes other than those that they were hired.  Direxion also restricts access to such information to those employees, agents, or other parties who need to know the information in order to service your accounts or investments.  These persons and entities are contractually bound to use that information only for the services for which we hired them. They are not permitted to use or share your non-public personal or financial information for any other purpose. There also may be times when we provide your information to federal, state, or local authorities or other regulatory agencies, such as the Securities and Exchange Commission or the National Futures Association as required by applicable law, regulation, or court order. 

In the event you hold shares of a Fund through a financial intermediary, such as a broker-dealer, bank, or trust company, the privacy policy of your financial intermediary governs how your non-public personal and financial information will be shared with nonaffiliated third parties.
